Niche Fusion are based in the United Kingdom and therefore comply with UK law. We reserve the right to refuse any individuals or entities the right or ability to serve as an Affiliate hereunder for any reason. We reserve the right to cancel any affiliate account due to fraud or any illegal activity.
The affiliate guarentees the following...
A) I am eighteen (18) years of age or of legal age to view pornography. I will provide proof on request.
B) I am entering this Agreement as an independent contractor and am therefore responsible for my own taxes due.
C) I am using web hosting that permits the use of adult content. D) The content, images, design, URL/Domain, text, and domains on my promotional pages do not break any copyright / trademark laws.
E) I am not publishing any material that is or could reasonably be interpreted as illegal material including but not limited to beastiality, rape, torture, scat, urination or underage pornography.
F) I am not advertising any files, data, viruses, worms, e-mail acquisition programs, "Trojan" viruses, or any other monitoring applications along with password trading websites.
A) An affiliate will be paid 50% commission by CCBill (minus fees which are split with Niche Fusion).
B) Niche Fusion will only pay commissions for subscriptions from referrals by Affiliate that result in paid funds. If any website user chargebacks or fails to make a payment, the affiliate will not be credited for that user. All chargebacks and alternative statistics are available in our affiliate members area. If payment has already been made and a chargeback occurs, the affiliate will be deducted the amount.
A) Affiliate may use any form of promotion providing it is consented in this agreement. Acceptable methods of promotion include: tgp / mgp galleries, freesites, banner adverts, text links, freehostedgalleriesor text links. IN NO WAY IS EMAIL PROMOTION ALLOWED. Any affiliate found to be promoting Niche Fusion's websites via e-mail shall have their account terminated and outstanding payments due cancelled. Any promotion using unauthorised e-mail (SPAM) is STRICTLY FORBIDDEN. Optin and double opt in programs are also forbidden. B) Content zip files are provided for the use of promoting NicheFusion's websites only. Any unauthorised use of content will result in termination of your affiliate account. C) Affiliate is responsible for following their local laws on pornography. If you are a US affiliate you are responsible for complying with 18 USC 2257. D) Affiliate is forbidden to promote our program in any way involved with child pornography or individuals who look younger than 18 years old or any scenes of rape, torture, fisting, urination, scat or beastiality. E) Affiliate will take necessary precautions to ensure that minors do not access their promotional material.
Either Party may terminate this Agreement at any time, with or without cause, by giving the other Party notice thereof. Notice by email is considered sufficient to terminate this Agreement.
